House of Faith v. Community School District 10 Bx(PDF)
This is the judicial opinion in the latest case involving religious freedom in New York City. Until 2005, New York City public schools banned all outside use of school buildings for worship, although not for religious groups to meet. House of Faith, a Christian congregation, had been denied use of a middle school in CSD 10 based on the "separation of church and state" regulations of the City schools. When a Connecticut case involving this issue was decided by the Supreme Court in favor of a similar use, the judge reversed herself, and permitted the use of the building for worship. The ban, she said, following the Supreme Court ruling, involved "impermissible viewpoint discrimination."
